Restraining Orders

A restraining order is a court order that can protect you from being physically abused, threatened, stalked, or harassed.

 The procedure for obtaining a restraining order is:

• 1. complete the forms for a court hearing and for a temporary restraining order,

  2. file the forms with the court,

  3. verify if the judge granted the request for a hearing and/or the temporary restraining order,

  4. have the restrained party served with the court documents at least 5 days before the hearing,

  5. file the proof of service,

  6. appear in court on the hearing date.

The procedure for defending against a restraining order is:

• 1. complete a Response to the restraining order,

  2. have the protected party served with the Response,

  3. file the Response and Proof of Service with the court at least 3 days before the hearing,

  4. relinquish all weapons and file proof of relinquishment with the court, and

  5. appear in court on the hearing date.
